These Terms & Conditions apply to bookings made with The Crawlers through www.thecrawlers.nl, by email, or through another authorised sales channel.

Please read these Terms before making a booking.

1. About The Crawlers

In these Terms, “The Crawlers”, “we”, “us” and “our” refer to The Crawlers V.O.F.

“Participant” means any person taking part in an Experience.

“Booking” means an agreement to purchase an Experience from The Crawlers.

“Experience” includes our public pub crawls, private nightlife experiences, customised experiences and other activities or combinations of activities sold by The Crawlers.

2. Booking and acceptance of these Terms

A Booking becomes binding when payment has been successfully completed and The Crawlers has issued a booking confirmation.

Before completing a Booking, the customer will be given access to these Terms and must accept them.

The booking page and confirmation will state the important details of the specific Experience, including the date, price, meeting information, scheduled time, main inclusions and any specific conditions.

If a specific written agreement for a private or customised Experience differs from these general Terms, the specifically agreed written conditions take priority for that Booking.

3. Prices and payment

Prices are shown on the relevant booking page and include applicable taxes unless stated otherwise.

Payment must be made using one of the payment methods available during checkout.

A Booking is not confirmed until payment has been successfully received or The Crawlers has expressly confirmed otherwise in writing.

Participants are responsible for their own additional purchases during the Experience, including additional drinks, food, transportation and other personal expenses unless expressly stated as included.

4. The Amsterdam Pub Crawl

The area, number of venues, starting time, expected finishing time and inclusions are shown on the relevant booking page.

Where a Booking states that admission to a specified number of bars and/or clubs, welcome drinks or venue discounts are included, these benefits form part of the Booking subject to these Terms.

Additional alcoholic drinks are not included unless expressly stated.

Alcohol is sold and served by the individual licensed venues and not by The Crawlers.

Venue-specific drink discounts may vary between venues.

5. Hosted experience and movement between venues

The Crawlers operates the Pub Crawl as a hosted nightlife experience.

Participants meet The Crawlers hosts at the participating venues.

Between venues, Participants receive the next venue location, approximate meeting time and/or digital navigation information through WhatsApp or another communication method used for the Experience.

Participants make their own way between venues. The Crawlers does not undertake to guide Participants through public streets between venues.

Participants are free to choose their own route, walking pace and time of departure, provided that they arrive within the communicated timeframe if they wish to receive all included benefits.

The Crawlers hosts may be present at each venue to welcome Participants, coordinate admission, organise the Experience and assist Participants.

Hosts being present at participating venues does not mean that The Crawlers provides transportation between venues.

6. WhatsApp and digital itinerary

The Crawlers may use WhatsApp or another digital communication service to provide:

• venue locations and Google Maps links;

• meeting times;

• itinerary changes;

• operational information;

• assistance during the Experience.

Participants should have access to a functioning smartphone during the Experience.

Where a WhatsApp group is used, other group members may be able to see information such as the Participant's phone number, display name or profile picture depending on the platform and the Participant's privacy settings.

Participants who do not wish to participate in a WhatsApp group should contact The Crawlers before the Experience. Where reasonably possible, an alternative method of receiving the itinerary will be provided.

7. Minimum age and identification

All nightlife Experiences involving bars or clubs are 18+ unless expressly stated otherwise.

Every Participant must bring an original, valid government-issued identification document acceptable to the participating venues.

A photograph, screenshot or copy of an identification document may not be accepted.

The Crawlers and participating venues may refuse participation or admission if a Participant:

• is under 18;

• cannot provide acceptable identification;

• provides false identification; or

• otherwise fails to satisfy a venue's lawful age or identification requirements.

No refund is due when participation or entry is refused because the Participant failed to comply with these requirements.

8. Cancellation and rescheduling by the Participant

For standard public Experiences:

Cancellation at least 24 hours before the scheduled starting time:
The customer may request a full refund or one free rescheduling to another available date.

Cancellation less than 24 hours before the scheduled starting time:
The Booking is non-refundable. The Crawlers may permit one free rescheduling where availability allows, but this is subject to availability and is not guaranteed.

If the requested alternative date is full or unavailable, this does not create a right to a refund for a late cancellation.

No-show: no refund.

A Participant who arrives late may join the Experience at a later venue using the itinerary information provided. No partial refund is given for venues, drinks, activities or other inclusions missed because of late arrival.

Bookings for leisure activities taking place on a specific date or during a specific period are generally excluded from the statutory 14-day withdrawal right applicable to many online purchases. This is why the cancellation policy above applies to the standard dated Experiences. The EU Consumer Rights Directive contains this specific fixed-date leisure exception.

Any mandatory consumer rights that cannot legally be excluded remain unaffected.

9. Cancellation or changes by The Crawlers

If The Crawlers cancels an Experience, the customer may choose between:

• a full refund of the amount paid for the cancelled Experience; or

• rescheduling to another available date.

The Crawlers may reasonably modify the route, schedule or individual venue where necessary because of circumstances including:

• unexpected venue closure;

• capacity problems;

• safety concerns;

• weather;

• venue requirements;

• instructions from authorities;

• changes in applicable laws or regulations;

• transport disruption; or

• other circumstances outside our reasonable control.

Where possible, The Crawlers will provide a comparable substitute venue or inclusion.

If a substantial part of the booked Experience cannot be provided and no reasonable replacement can be offered, The Crawlers will provide an appropriate refund or other remedy taking into account the part of the Experience that could not be provided.

10. Weather

The Experiences normally continue in rain and ordinary Amsterdam weather conditions.

Participants should dress appropriately for the weather because movement between venues takes place outdoors.

If weather or another safety condition makes it unreasonable or impossible to operate the Experience, The Crawlers may cancel or materially modify it.

Where The Crawlers cancels the Experience, the customer may choose between a refund or rescheduling.

11. Venue admission

Bars, clubs and other venues participating in an Experience are independent businesses.

Each venue retains final authority over matters including:

• admission;

• identification;

• dress code;

• alcohol service;

• security;

• behaviour inside the venue;

• opening hours; and

• compliance with its licence and legal obligations.

The Crawlers cannot require a venue to admit or serve a Participant who does not satisfy the venue's lawful requirements.

Where the Participant complies with these Terms but an advertised venue becomes unavailable for reasons unrelated to the Participant, The Crawlers will make reasonable efforts to provide a comparable replacement venue or equivalent benefit.

12. Welcome drinks and alcohol

Where welcome drinks are included in the Booking, they are provided by participating venues.

Alcoholic service is always subject to the venue's legal and responsible-service obligations.

A venue may refuse to serve alcohol to a Participant who is excessively intoxicated, behaving dangerously or otherwise should not legally or responsibly be served.

Such refusal does not entitle the Participant to a refund where it results from the Participant's own condition or behaviour.

Where an included welcome drink cannot be provided for reasons unrelated to the Participant, The Crawlers will make reasonable efforts to provide a comparable alternative.

Participants decide for themselves whether and how much alcohol they consume.

There is no requirement to consume alcohol in order to participate in The Crawlers.

13. Participant behaviour

Participants must behave respectfully towards:

• other Participants;

• The Crawlers hosts;

• venue staff and security;

• residents;

• members of the public; and

• property belonging to other people or businesses.

The following behaviour is prohibited:

• violence or threats of violence;

• harassment or unwanted sexual behaviour;

• discrimination;

• intimidation;

• aggressive or seriously disruptive behaviour;

• theft or deliberate property damage;

• possession, supply or use of illegal drugs;

• consumption or use of substances in locations where this is prohibited;

• excessive public noise or disturbance;

• drinking alcohol in public where prohibited;

• ignoring reasonable safety instructions; and

• conduct that violates applicable law or venue rules.

14. Removal from the Experience

The Crawlers may refuse participation or remove a Participant where reasonably necessary for safety, compliance or the enjoyment of other Participants.

This includes situations involving serious intoxication, aggression, harassment, discrimination, illegal activity, repeated disruption or failure to comply with reasonable instructions.

Where removal results from the Participant's behaviour or breach of these Terms, no refund will be provided.

If necessary, The Crawlers may contact venue security, police, emergency services or other appropriate authorities.

15. Dress code and bags

Participants must dress appropriately for Amsterdam nightlife venues.

Unless the booking information states otherwise, the general dress code is smart casual / appropriate nightlife clothing.

The following may result in refusal of entry:

• sweatpants;

• tracksuits;

• gym or sportswear;

• gym shorts;

• flip-flops;

• inappropriate or heavily soiled clothing; and

• other clothing prohibited by the individual venue.

Clean casual footwear and sneakers are generally acceptable unless a particular venue applies a stricter policy.

Large backpacks and luggage are not permitted.

Small handbags, purses and small personal bags are permitted subject to venue security policies.

Individual venues always retain final authority over dress code and admission.

16. Pets and assistance animals

Pets are not permitted on the standard Pub Crawl.

Participants requiring an assistance animal should contact The Crawlers before booking so that accessibility and the policies of the relevant venues can be checked.

17. Safety and personal responsibility

Nightlife activities involve inherent risks associated with crowds, walking through a city at night, alcohol consumption and interaction with third parties.

Participants remain responsible for their own decisions, behaviour, alcohol consumption and personal safety.

Participants must follow applicable laws and reasonable safety instructions.

The Crawlers hosts may assist a Participant in obtaining help where reasonably possible.

In an emergency, The Crawlers may contact emergency services.

18. Transport and getting home

Transportation to the meeting point, between venues and home after the Experience is not included unless expressly stated.

Each Participant is responsible for arranging their own transportation.

The Crawlers may, on request and where reasonably possible, assist with arranging a taxi, Uber or other third-party transport service.

Any transportation contract is between the Participant and the relevant transport provider. The Crawlers does not operate or control that transport service and does not guarantee its availability, price or performance.

19. Personal belongings

Participants are responsible for their own phones, wallets, identification documents, clothing, bags and other belongings.

Participants should keep valuables secure at all times.

To the extent permitted by law, The Crawlers is not responsible for property that is lost, stolen or damaged by a Participant, another Participant, a venue or another third party unless the loss was directly caused by a legally attributable failure of The Crawlers.

20. Photography and video

The Crawlers may photograph or record Experiences for promotional or social-media purposes.

Promotional use of identifiable images or video of a Participant will require appropriate consent.

A Participant may refuse to be photographed or filmed for promotional purposes and may still participate fully in the Experience.

Where practical, Participants who do not wish to appear in promotional material should inform the host.

Any separate photo/video consent can be withdrawn for future use in accordance with the applicable Privacy Policy and law, although withdrawal may not affect lawful use that already occurred before withdrawal.

21. Personal data

The Crawlers may process information including names, email addresses, telephone numbers, booking information and communications where necessary to:

• manage the Booking;

• operate the Experience;

• communicate venue locations and timings;

• provide customer support;

• meet legal and administrative obligations; and

• send reasonable post-Experience service communications such as a feedback or review request.

Personal information is processed in accordance with The Crawlers' Privacy Policy and applicable data-protection law. Businesses processing personal information need a lawful basis and may not retain information longer than necessary.

Promotional marketing communications will only be sent where The Crawlers has an appropriate lawful basis, including consent where required.

Participants can unsubscribe from marketing communications.

22. Ticket transfers

A standard ticket may be transferred to another person before the Experience unless the booking page states otherwise.

The replacement Participant must:

• satisfy all age and identification requirements;

• accept these Terms; and

• satisfy any other conditions applicable to the Booking.

The Crawlers may require advance notification of the replacement Participant's name.

Resale of tickets for commercial profit without permission from The Crawlers is not permitted.

23. Private and customised Experiences

The Crawlers may offer private or customised nightlife Experiences.

Details may be agreed by email or another written communication before payment, including:

• route;

• venues;

• timings;

• group size;

• inclusions;

• special requests;

• price; and

• specific cancellation conditions.

Any specific conditions expressly agreed in writing for a private or customised Booking take priority over conflicting provisions of these general Terms.

Requests are subject to availability, venue rules, applicable law and operational feasibility.

24. Partner activities and bundles

The Crawlers may sell Experiences combining a Crawlers activity with an activity performed by an independent partner, such as another tourism or entertainment provider.

The booking page will state the components included in the bundle.

Third-party operators remain responsible for performing the services they independently provide and may apply their own reasonable operational rules.

Where The Crawlers accepts payment for the complete bundle, The Crawlers remains responsible for the contractual obligations it has assumed towards the customer under the Booking and mandatory consumer law.

If mandatory package-travel or other travel-service legislation applies to a particular combination, those mandatory rules take priority over these Terms.

25. Accessibility

Nightlife venues and routes may have different accessibility characteristics.

Participants with mobility requirements, disabilities or other accessibility needs are encouraged to contact info@thecrawlers.nl before booking.

The Crawlers will make reasonable efforts to provide relevant accessibility information and accommodate reasonable requests, but cannot guarantee that every independent venue will be suitable for every accessibility requirement.

26. Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by mandatory Dutch or EU consumer law.

The Crawlers is responsible for loss or damage caused by a legally attributable failure by The Crawlers to perform its obligations.

The Crawlers is not responsible, to the extent permitted by law, for loss or damage resulting from circumstances attributable to:

• the Participant's own actions or decisions;

• excessive alcohol consumption;

• violation of these Terms;

• violation of law or venue rules;

• another Participant;

• an independent venue or third party;

• loss or theft of personal property not caused by The Crawlers; or

• circumstances outside The Crawlers' reasonable control.

Nothing in these Terms removes rights that a consumer cannot legally waive.

27. Damage caused by Participants

A Participant may be held responsible for damage they intentionally or negligently cause to:

• a venue;

• The Crawlers;

• another Participant;

• staff;

• equipment; or

• third-party property.

The affected venue or party may pursue the Participant directly where appropriate.

28. Force majeure and circumstances outside our control

The Crawlers is not responsible for failure to perform an obligation where performance is prevented by circumstances reasonably outside its control, subject always to mandatory consumer rights.

Examples may include severe weather, emergencies, government measures, unexpected venue closure, major transport disruption, public-order incidents or other exceptional events.

Where such circumstances cause The Crawlers to cancel the entire Experience, the refund/rescheduling provisions of Section 9 apply.

29. Complaints

Participants should raise operational problems with a Crawlers host during the Experience where reasonably possible so that we have an opportunity to resolve the issue.

Formal complaints can be sent to:

Please include the Booking name, date of the Experience and a description of the issue.

The Crawlers will aim to respond within a reasonable period.

Nothing in this complaints procedure limits a Participant's statutory consumer rights.

30. Changes to these Terms

The version of these Terms accepted at the time of Booking applies to that Booking.

The Crawlers may update these Terms for future Bookings.

A later version will not retroactively reduce the contractual rights of an existing confirmed Booking unless required by law or expressly agreed with the customer.

31. Dutch law and disputes

These Terms and Bookings with The Crawlers are governed by Dutch law.

Any dispute will be submitted to the competent court in the Netherlands unless mandatory consumer law provides the Participant with the right to bring proceedings elsewhere.

Consumers residing in another EU or EEA country retain any mandatory consumer protection rights that apply to them and cannot legally be excluded by these Terms.

32. Language

These Terms may be provided in English and Dutch.

Both versions are intended to have the same meaning.

In the event of an unintended difference between the English and Dutch versions, the Dutch version will prevail, subject to mandatory consumer law.

Deze Algemene Voorwaarden zijn van toepassing op boekingen bij The Crawlers via www.thecrawlers.nl, per e-mail of via een ander door The Crawlers goedgekeurd verkoopkanaal.

Lees deze voorwaarden voordat u een boeking maakt.

In deze voorwaarden verwijzen “The Crawlers”, “wij”, “ons” en “onze” naar The Crawlers V.O.F.

“Deelnemer” betekent iedere persoon die deelneemt aan een Experience.

“Boeking” betekent een overeenkomst voor de aankoop van een Experience bij The Crawlers.

“Experience” omvat onze openbare pub crawls, privé-uitgaanservaringen, op maat gemaakte Experiences en andere activiteiten of combinaties van activiteiten die door The Crawlers worden verkocht.

2. Boeking en aanvaarding van deze voorwaarden

Een Boeking wordt bindend zodra de betaling succesvol is voltooid en The Crawlers een boekingsbevestiging heeft verstrekt.

Voor het afronden van een Boeking krijgt de klant de mogelijkheid deze Algemene Voorwaarden te lezen en te accepteren.

Op de boekingspagina en in de bevestiging staan de belangrijkste gegevens van de specifieke Experience, waaronder de datum, prijs, ontmoetingsinformatie, geplande tijd, belangrijkste inbegrepen onderdelen en eventuele bijzondere voorwaarden.

Indien voor een privé- of op maat gemaakte Experience specifieke voorwaarden schriftelijk zijn overeengekomen, hebben deze specifieke afspraken voor die Boeking voorrang op deze algemene voorwaarden.

3. Prijzen en betaling

De prijs staat vermeld op de relevante boekingspagina en is inclusief toepasselijke belastingen tenzij anders aangegeven.

Betaling vindt plaats via een van de betaalmethoden die tijdens het afrekenen worden aangeboden.

Een Boeking is pas bevestigd nadat de betaling succesvol is ontvangen, tenzij The Crawlers schriftelijk anders bevestigt.

Extra aankopen tijdens de Experience, waaronder extra drankjes, eten, vervoer en persoonlijke uitgaven, zijn voor rekening van de Deelnemer tenzij uitdrukkelijk is vermeld dat deze zijn inbegrepen.

4. Amsterdam Pub Crawl

De exacte route, het aantal locaties, de aanvangstijd, verwachte eindtijd en inbegrepen onderdelen staan op de relevante boekingspagina.

Wanneer bij een Boeking toegang tot een bepaald aantal bars en/of clubs, welkomstdrankjes of kortingen wordt vermeld, maken deze onderdelen deel uit van de Boeking onder deze voorwaarden.

Extra alcoholische dranken zijn niet inbegrepen tenzij uitdrukkelijk anders vermeld.

Alcohol wordt verkocht en geschonken door de afzonderlijke horecagelegenheden en niet door The Crawlers.

Kortingen kunnen per locatie verschillen.

5. Hosted Experience en verplaatsing tussen locaties

The Crawlers organiseert de Pub Crawl als een hosted nightlife experience.

Deelnemers ontmoeten de hosts van The Crawlers bij de deelnemende horecagelegenheden.

Tussen locaties ontvangen Deelnemers via WhatsApp of een ander communicatiemiddel de volgende locatie, het verwachte tijdstip en/of digitale navigatie-informatie.

Deelnemers begeven zich zelfstandig van de ene locatie naar de andere. The Crawlers begeleidt Deelnemers niet door de openbare ruimte tussen de locaties.

Deelnemers bepalen zelf hun route, loopsnelheid en tijdstip van vertrek, mits zij tijdig bij de volgende locatie aankomen om gebruik te kunnen maken van de inbegrepen onderdelen.

Hosts van The Crawlers kunnen bij de locaties aanwezig zijn om Deelnemers te ontvangen, toegang te coördineren, de Experience te organiseren en ondersteuning te bieden.

6. WhatsApp en digitale route

The Crawlers kan WhatsApp of een vergelijkbare communicatiedienst gebruiken voor locaties, Google Maps-links, tijden, wijzigingen en praktische informatie.

Deelnemers wordt aangeraden tijdens de Experience toegang te hebben tot een werkende smartphone.

Wanneer een WhatsApp-groep wordt gebruikt, kunnen andere deelnemers afhankelijk van de instellingen mogelijk gegevens zien zoals telefoonnummer, profielnaam of profielfoto.

Een Deelnemer die geen gebruik wil maken van een WhatsApp-groep dient vóór de Experience contact op te nemen. Waar redelijkerwijs mogelijk zal een alternatief worden aangeboden.

7. Leeftijd en identificatie

Nightlife Experiences met bars of clubs zijn uitsluitend toegankelijk voor personen van 18 jaar of ouder, tenzij uitdrukkelijk anders vermeld.

Iedere Deelnemer moet een geldig, origineel en door de overheid uitgegeven identiteitsdocument meenemen dat door de betreffende locatie wordt geaccepteerd.

The Crawlers of een locatie kan deelname of toegang weigeren indien een Deelnemer minderjarig is, geen geldig identiteitsbewijs heeft, valse identificatie gebruikt of niet voldoet aan wettelijke identificatievereisten.

In deze situaties bestaat geen recht op terugbetaling.

8. Annulering en omboeken door de Deelnemer

Bij annulering minimaal 24 uur vóór de geplande aanvangstijd kan de klant kiezen voor volledige terugbetaling of één gratis omboeking naar een beschikbare datum.

Bij annulering minder dan 24 uur vóór aanvang bestaat geen recht op terugbetaling.

The Crawlers kan, indien beschikbaar, één gratis omboeking toestaan. Dit is afhankelijk van beschikbaarheid en niet gegarandeerd.

Wanneer een alternatieve datum vol of niet beschikbaar is, ontstaat daardoor geen recht op terugbetaling.

Bij een no-show wordt geen terugbetaling verstrekt.

Een te laat gearriveerde Deelnemer kan bij een volgende locatie aansluiten. Er wordt geen gedeeltelijke terugbetaling verstrekt voor gemiste onderdelen.

9. Annulering of wijziging door The Crawlers

Wanneer The Crawlers de Experience annuleert, kan de klant kiezen tussen volledige terugbetaling of kosteloos omboeken naar een beschikbare datum.

The Crawlers mag de route, planning of locatie redelijkerwijs aanpassen indien dit noodzakelijk is door bijvoorbeeld onverwachte sluiting, capaciteit, veiligheid, weer, eisen van locaties, instructies van autoriteiten of wijzigingen in wet- en regelgeving.

Waar mogelijk wordt een vergelijkbare vervangende locatie of een gelijkwaardig onderdeel aangeboden.

Wanneer een wezenlijk deel van de Experience niet kan worden geleverd en geen redelijke vervanging mogelijk is, biedt The Crawlers een passende terugbetaling of andere oplossing.

10. Weer

De Experiences gaan normaal gesproken door bij regen en normale Amsterdamse weersomstandigheden.

Bij omstandigheden waardoor uitvoering onveilig of redelijkerwijs onmogelijk wordt, kan The Crawlers de Experience annuleren of wezenlijk aanpassen.

Bij annulering door The Crawlers kan de klant kiezen voor terugbetaling of omboeken.

11. Toegang tot locaties

Bars, clubs en andere deelnemende locaties zijn zelfstandige ondernemingen.

Elke locatie beslist uiteindelijk zelf over toegang, identiteitscontrole, kledingvoorschriften, alcoholverstrekking, beveiliging en gedrag binnen de locatie.

The Crawlers kan een locatie niet verplichten een Deelnemer toe te laten of alcohol te schenken wanneer de Deelnemer niet aan de wettelijke of redelijke voorwaarden voldoet.

Wanneer een geadverteerde locatie buiten de schuld van de Deelnemer niet beschikbaar is, probeert The Crawlers een vergelijkbaar alternatief of gelijkwaardig voordeel te bieden.

12. Welkomstdrankjes en alcohol

Inbegrepen welkomstdrankjes worden verstrekt door deelnemende horecagelegenheden.

Het schenken van alcohol blijft altijd onderworpen aan de wettelijke en verantwoordelijke verstrekkingsregels van de betreffende locatie.

Een locatie kan weigeren alcohol te schenken aan een Deelnemer die ernstig onder invloed is, gevaarlijk gedrag vertoont of redelijkerwijs niet meer verantwoord kan worden bediend.

Een dergelijke weigering geeft geen recht op terugbetaling wanneer deze voortvloeit uit de toestand of het gedrag van de Deelnemer.

Deelname aan The Crawlers vereist geen alcoholconsumptie.

13. Gedrag

Deelnemers moeten respectvol omgaan met andere Deelnemers, hosts, medewerkers van locaties, beveiliging, bewoners en andere personen.

Geweld, bedreigingen, intimidatie, ongewenst seksueel gedrag, discriminatie, agressief gedrag, diefstal, opzettelijke schade, illegale drugs, verboden middelengebruik en andere overtredingen van wet- of huisregels zijn niet toegestaan.

14. Verwijdering

The Crawlers kan deelname weigeren of een Deelnemer verwijderen indien dit redelijkerwijs noodzakelijk is voor veiligheid, naleving van regels of het welzijn van andere deelnemers.

Wanneer verwijdering het gevolg is van het gedrag van de Deelnemer of een overtreding van deze voorwaarden, bestaat geen recht op terugbetaling.

Indien nodig kan The Crawlers beveiliging, politie of hulpdiensten inschakelen.

15. Kleding en tassen

De algemene kledingvoorschriften zijn smart casual / geschikte uitgaanskleding.

Joggingbroeken, trainingspakken, sportkleding, sportshorts, slippers, sterk vervuilde kleding en andere kleding die door een locatie wordt geweigerd kunnen leiden tot weigering van toegang.

Grote rugzakken en bagage zijn niet toegestaan.

Kleine handtassen, purses en kleine persoonlijke tassen zijn toegestaan, onder voorbehoud van de regels van de locatie.

De betreffende locatie heeft altijd het laatste woord over toegang.

16. Huisdieren en assistentiedieren

Huisdieren zijn niet toegestaan bij de standaard Pub Crawl.

Deelnemers die gebruikmaken van een assistentiedier dienen vooraf contact op te nemen zodat de toegankelijkheid en regels van de deelnemende locaties kunnen worden gecontroleerd.

17. Veiligheid en eigen verantwoordelijkheid

Nightlife Experiences brengen risico's met zich mee die horen bij drukke locaties, lopen in een stad gedurende de avond, alcoholconsumptie en interactie met derden.

Deelnemers blijven verantwoordelijk voor hun eigen keuzes, gedrag, alcoholconsumptie en persoonlijke veiligheid.

Hosts kunnen waar redelijkerwijs mogelijk ondersteuning bieden.

Bij een noodsituatie kan The Crawlers hulpdiensten inschakelen.

18. Vervoer en thuiskomst

Vervoer naar het ontmoetingspunt, tussen locaties en na afloop is niet inbegrepen tenzij uitdrukkelijk anders vermeld.

De Deelnemer is zelf verantwoordelijk voor vervoer.

The Crawlers kan waar redelijkerwijs mogelijk helpen bij het regelen van een taxi, Uber of andere externe vervoerder.

The Crawlers is zelf geen vervoerder en garandeert de beschikbaarheid of uitvoering van dergelijke diensten niet.

19. Persoonlijke eigendommen

Deelnemers zijn verantwoordelijk voor hun telefoon, portemonnee, identiteitsdocumenten, kleding, tassen en andere persoonlijke eigendommen.

Voor zover wettelijk toegestaan is The Crawlers niet verantwoordelijk voor verlies, diefstal of schade die niet rechtstreeks is veroorzaakt door een aan The Crawlers toerekenbare tekortkoming.

20. Foto en video

The Crawlers kan tijdens Experiences foto's en video's maken voor promotionele doeleinden.

Voor promotioneel gebruik van herkenbare beelden van een Deelnemer wordt passende toestemming gevraagd.

Een Deelnemer mag weigeren gefilmd of gefotografeerd te worden en kan desondanks volledig deelnemen aan de Experience.

21. Persoonsgegevens

The Crawlers kan persoonsgegevens verwerken die noodzakelijk zijn voor de Boeking, uitvoering van de Experience, communicatie, klantenservice en wettelijke administratie.

De verwerking vindt plaats overeenkomstig de Privacy Policy en toepasselijke privacywetgeving.

Marketingcommunicatie wordt uitsluitend verzonden wanneer daarvoor een geldige juridische grondslag bestaat.

22. Overdracht van tickets

Een standaardticket kan vóór de Experience worden overgedragen aan een andere persoon tenzij op de boekingspagina anders is bepaald.

De nieuwe Deelnemer moet aan alle leeftijds-, identificatie- en andere voorwaarden voldoen en deze Algemene Voorwaarden accepteren.

23. Privé- en op maat gemaakte Experiences

Voor privé- of op maat gemaakte Experiences kunnen specifieke afspraken worden gemaakt over route, locaties, tijd, groepsgrootte, inbegrepen onderdelen, prijs en annulering.

Deze afspraken moeten vooraf schriftelijk worden bevestigd.

Specifiek overeengekomen voorwaarden hebben voor die Boeking voorrang wanneer zij uitdrukkelijk afwijken van deze algemene voorwaarden.

24. Partneractiviteiten en bundels

The Crawlers kan combinaties verkopen waarin een activiteit van The Crawlers wordt gecombineerd met een dienst van een zelfstandige partner.

Op de boekingspagina wordt aangegeven welke onderdelen zijn inbegrepen.

Externe partners blijven verantwoordelijk voor de diensten die zij zelf uitvoeren.

Wanneer The Crawlers betaling voor de volledige bundel accepteert, blijft The Crawlers verantwoordelijk voor de contractuele verplichtingen die het in de Boeking tegenover de klant heeft aanvaard en voor zover dwingend consumentenrecht dit vereist.

25. Toegankelijkheid

Toegankelijkheid verschilt per locatie en route.

Deelnemers met specifieke toegankelijkheidsbehoeften kunnen vóór het boeken contact opnemen via info@thecrawlers.nl.

The Crawlers zal redelijke inspanningen leveren om relevante informatie te verstrekken en redelijke verzoeken te ondersteunen.

26. Aansprakelijkheid

Niets in deze voorwaarden sluit aansprakelijkheid uit wanneer uitsluiting op grond van dwingend Nederlands of Europees consumentenrecht niet is toegestaan.

The Crawlers is aansprakelijk voor schade die het gevolg is van een juridisch toerekenbare tekortkoming van The Crawlers.

Voor zover wettelijk toegestaan is The Crawlers niet verantwoordelijk voor schade die voortvloeit uit het eigen gedrag van een Deelnemer, overmatig alcoholgebruik, overtreding van deze voorwaarden, overtreding van wet- of huisregels, handelen van andere Deelnemers of derden, of omstandigheden buiten de redelijke invloed van The Crawlers.

Dwingende consumentenrechten blijven altijd van toepassing.

27. Schade veroorzaakt door Deelnemers

Een Deelnemer kan aansprakelijk worden gesteld voor schade die hij of zij opzettelijk of door nalatigheid veroorzaakt aan een locatie, The Crawlers, andere Deelnemers, medewerkers of eigendommen van derden.

28. Overmacht

The Crawlers is niet verantwoordelijk voor het niet uitvoeren van een verplichting wanneer uitvoering redelijkerwijs onmogelijk wordt gemaakt door omstandigheden buiten haar invloed, met behoud van dwingende consumentenrechten.

Bij annulering van de volledige Experience zijn de bepalingen van artikel 9 van toepassing.

29. Klachten

Operationele problemen kunnen waar mogelijk tijdens de Experience bij een host worden gemeld.

Formele klachten kunnen worden gestuurd naar:

info@thecrawlers.nl

Vermeld daarbij de naam van de Boeking, datum en een beschrijving van het probleem.

Deze klachtenprocedure beperkt wettelijke consumentenrechten niet.

30. Wijzigingen van deze voorwaarden

Op een Boeking is de versie van de voorwaarden van toepassing die op het moment van boeken is geaccepteerd.

The Crawlers kan deze voorwaarden voor toekomstige Boekingen wijzigen.

Nieuwe voorwaarden verminderen niet met terugwerkende kracht de rechten van bestaande bevestigde Boekingen.

31. Nederlands recht

Op deze Algemene Voorwaarden en de overeenkomsten met The Crawlers is Nederlands recht van toepassing.

Geschillen worden voorgelegd aan de bevoegde Nederlandse rechter, tenzij dwingend consumentenrecht de Deelnemer het recht geeft het geschil elders voor te leggen.

Consumenten uit andere EU- of EER-landen behouden de dwingende consumentenbescherming die wettelijk op hen van toepassing is.

32. Taal

Deze Algemene Voorwaarden kunnen in het Nederlands en Engels beschikbaar worden gesteld.

Beide versies zijn bedoeld dezelfde betekenis te hebben.

Bij een onbedoeld verschil tussen beide versies heeft de Nederlandse versie voorrang, met behoud van dwingend consumentenrecht.
